What is being a lawyer?

For most people, the lawyer is the “problem solver”, someone you turn to when a situation is beyond you, when you may feel you have no other options or the last person who can help you in already very complicated situations.

It is then, when you have usually run out of options, that you seek the guidance and advice of a professional, before resigning yourself to what you have been dealt.

However, in our opinion, it would be much better if we conceived the figure of the lawyer, as happens in other countries, as an “advisor” (in English, one of the synonyms of lawyer is “counselor”): someone to turn to when we have doubts about a business deal, an agreement, applying for a licence or taking a public action, but before facing any kind of legal requirement.

It is at that moment when our options multiply and the chances that what we want to do will go well and will not have negative consequences for us are much higher.

In general, we do not consult a lawyer because we believe that their work is reserved only for problems that are going to end up in court, when in most cases they could be solved much sooner, with the right guidance and knowledge.

Our method

Listen, study and consult. There will always, always be at least two of us lawyers who will review your case, your documentation and who will prepare the whole procedure. This means that we have two visions, double capacity and half the chance of getting it wrong.

Depending on what you need, we will try to choose the most experienced and knowledgeable partner to review and complete any documents and paperwork you need.

Whenever possible, we will try to reach an amicable solution, an agreement, a settlement… why? Because going to court should always be the last option.

Court proceedings are long, costly and their outcome depends to a large extent on a series of factors that we cannot control: the inclinations, tastes and opinions of judges and prosecutors, the situation in which a particular court finds itself, the documentation available to the opposing party, the greater or lesser success of their own lawyers, etc.

Even if we see a very clear case, we must bear in mind that if someone is willing to go to court, it is because they are at least as clear about it as you are.

To give you an idea, a simple procedure, such as claiming a debt of less than €6,000, an eviction for non-payment or enforcing a court decision, can take around a year.

A more complex procedure in which there are several phases, such as all those that exceed €6,000, an inheritance, a liquidation of a community of property… could take more than two or three years and in some cases go on for 5 or 6 years, with a bit of bad luck (or a bad idea).

For this reason, legal proceedings should be reserved for those conflicts in which it is impossible to reach an agreement, and always after having tried, because the costs, both in terms of professionals and time, are high.

To give you an example: a divorce by mutual agreement can cost around €1,000 in total and take around 6 months. A contentious one involving a trial doubles the cost and triples the time, easily exceeding €2,000 and 2 years.
