How long do I have to claim for hidden defects?
You have to be very careful, because the period is very short, 6 months from the delivery of the thing sold, and it is of expiry, that is to say, it is not interrupted by starting the claim.
Moreover, it has very specific requirements:
- They have to be serious defects, hidden or not apparent.
- They have to be prior to the sale.
- They cannot be seen with the naked eye.
If the defect is so serious that the thing does not serve its purpose (for example, a car that does not run), the time limit is 5 years.
How do you claim against an insurance company that does not want to cover a claim?
The main thing is to provide all the documentation and visits that the insurance company needs.
Once they reply that they do not cover it is when you should hire a lawyer.
To begin with, we will send a burofax claiming compensation or reparation and if they do not respond or do so negatively, we will have to hire our own expert to make a report. With this report we will go to court.
What about car accidents?
This is the most common type of accident in Spain and has its own regulations.

Of course, when you hire a work, a painter or a cleaning service, you can demand in Court the fulfilment of the contract you signed with them, even if it was done verbally or if it was not declared for tax purposes (that issue does not matter in Court).
You can demand that they finish the job properly or that they pay someone else to finish it for them, if you no longer have confidence that they will do it properly.
What are the costs of these procedures?
Normally, the lawyer will only charge a percentage of what you receive as compensation and at the time you receive it.
These percentages are usually between 15% and 25%, depending on the procedures, the difficulty and the compensation calculated.
What is the term of a guarantee for a product purchased as a consumer?
In 2021, an amendment to the consumer law was passed which extends product guarantees from two to three years, as well as guaranteeing the supply of spare parts for ten years after the disappearance of the products.
What if I bought something from you at an auction or public tender?
These contracts have their own laws, procedures and courts, as well as long and complex “specifications”, which are published before the sale is made.
