How long does an accident claim take?
The time it takes to receive compensation for a traffic or work accident is quite short, a few months after you are medically discharged.
Normally you will receive an offer of payment from the insurer, but by default they usually pay about 50% of what you are actually entitled to. Therefore, we must make our own medical assessment and, in many cases, sue them in court, with a time limit of between 1 and 2 years depending on the amount of money we claim.
Claims against the SAS, the Town Hall, etc., will almost always go to court, so it can easily take 2-3 years.
What is the cost of the procedure?
In accident and insurance claims, we only charge if you get paid, and only when you get paid.
We charge a percentage of 15% of the amount you receive and, in many cases, this cost will also be borne by the insurer, because they have legal defence cover or because they are a condemnation of the claim.
How do you claim compensation for a traffic accident?
The main thing is to have it handled by a lawyer from the first minute, because it is very important to go to the doctor on the day of the accident and to follow a very specific process.
Normally, the insurance company will offer you a “free lawyer”, who in practice works for them and will only look after their interests. We recommend you to have your own lawyer from the day of the accident, who will review the whole procedure and claim everything that should be paid to you in an impartial way.
Once the medical treatment is finished and you are discharged, the company will do its own medical review and in a few days will offer you a compensation with immediate payment, as we have said, which will be about 50% of what they really have to pay you, or they will reply that they are not going to pay you anything.
In either case, we will need an expert report from our own doctor. Once we send them our own medical report, they will usually make another offer, higher but far from the real one. At that point you will have to file a lawsuit and start legal proceedings.
Once the procedure is iniciated, the insurance company can pay what has been agreed, make a new offer or oppose, so you will have to evaluate each option, with what is in your best interest in terms of the time in which it is paid and the money you receive. If no agreement is reached, there will be one or more hearings in Court and then there will be a judgement, in which the Judge decides how much the insurer will pay.
What about proceedings against the Andalusian Health Service or other Public Administrations?
These are special proceedings called “patrimonial liability” and are brought before the Contentious-Administrative Court, which is special for public matters.
And that means they are long and more complex procedures, because it is very difficult for the administration to pay anything voluntarily. For this reason, claims are usually made when the after-effects and damage caused are significant.
