Family Law Lawyers
The scope of family law is very broad, as it includes from custody matters, modification of measures arising from a previous judgment, alimony, parental authority or any other matter related to family law, even derived from the criminal field and special procedures of gender violence.
It has broad personal, economic and family relations repercussions in the broadest sense, so many times a family lawyer can be of great help.

How a family lawyer can help you
Solving the possible problems that may arise during such a process.
These can vary depending on whether they involve disputes over visitation, shared or sole custody, alimony problems, enforcement of judgments, payment of extraordinary expenses or decisions relating to parental authority such as celebrating a first communion or travelling outside Spain.
However, no matter how complex the problem, a good family lawyer can help you find a solution. Whatever the problem is, it is very likely that the lawyer has dealt with it before, so he or she can provide you with the experience and knowledge necessary to resolve these cases, knowing in advance what a judge has ruled in similar proceedings.
What you need to know about the process of the case.
What you need to know about the process of the case
To get started, you will need to provide all relevant documentation:
- Marriage certificate.
- Birth records.
- Prenuptial agreements.
- Previous judgements.
- Other documentation related to your case.
At that time, your lawyer will identify any potential problems and advise you on next steps.
Timelines may vary depending on the nature of your case. For example, separation cases may take longer because of the need to divide assets and determine child custody.
However, an experienced lawyer can help speed up the process and ensure that all deadlines are met.
The best family lawyers in Malaga?
We would like to share with you some examples of successful cases in which we have worked as an inheritance lawyers here in Malaga:
Modification of custody arrangements: this is a legal procedure that may be necessary when circumstances change after a custody agreement has been established. For example, if one of the parents moves to a new city, or if the child has new educational or medical needs, it may be necessary to modify the custody agreement.
The custody modification process begins with the filing of a petition with the court. This petition must include evidence that there has been a significant change in circumstances that warrants modification of the custody arrangement. The court will review the petition and make a decision based on the best interests of the child.
In a recent case, we worked with a client who needed to modify his custody agreement due to a change in his work schedule.
We filed a petition with the court with evidence of the change in work schedule and how it would affect the time the client could spend with his child. After reviewing the petition, the court agreed to modify the custody agreement to allow our client to have more time with his son during his days off.
The liquidation of the community property: this is another legal procedure that may be necessary in divorce cases. This process involves the division of assets that the couple has accumulated during their marriage. This may include property, bank accounts, investments and other assets.
The process of liquidating the community property begins with the identification and valuation of all of the couple’s assets. These assets are then divided equally between the parties. In some cases, it may be necessary to sell some assets to achieve an equitable division.
In this case, we worked with a client who was going through a divorce and needed help with this process.
We identified and valued all of the couple’s assets, including a home, several investment accounts and a business. We then negotiated an equitable division of these assets, which was accepted by both parties and approved by the court.
Although this particular case went fairly quickly, the time to resolve a community property settlement case can vary depending on a number of factors, such as the complexity of the case, the amount and type of assets involved, and whether the process is mutually agreed or contentious.
These two cases are two of the most common examples of family law that we have dealt with, but there are many more. As we have mentioned, this law is very broad. So, if you need help:
Questions you may have
How long do family law proceedings take?
The time limits in these proceedings are usually relatively short, less than a year in some cases, although it depends a lot on what is being sought, whether there are minors, etc.
Those involving criminal liability can easily take 3-4 years.
What is the cost of the procedure?
In these cases, as they are normally judicial proceedings, the minimum cost will be around €1,000 and in the most complex cases it could be double that amount.
How do these procedures work?
They are initiated by filing a claim with the Court, with a lawyer and solicitor.
The Court will admit it if it meets the requirements and will send it to the other party and, if there are minors, to the Public Prosecutor, who will defend their interests in Court.
If they oppose the measures requested, unless an agreement is reached, there will be a trial and the judge will decide on what is requested, depending on the documentation, and what the witnesses and experts (normally psychologists) say at the trial.
Who is the BARRISTER?
This is the other professional whose intervention is compulsory in this type of proceedings. According to the definition given by the Consejo General de Procuradores de España, the BARRISTER is the procedural representative of the defendant. What does this mean? It means that BARRSTERS are responsible for:
- Follow the process, be aware of all the steps and keep the client and his lawyer informed.
- Be responsible for all the formalities: receive and sign summons, summons, notifications, etc.; attend all the necessary steps and acts of the lawsuit. All of this in representation of and on behalf of the client.
- Transmit to the lawyer all documents and instructions that come into his hands.
- Pay the expenses that are generated at the request of the client and give a documented account of them.
